The league are set to make a decision on whether Benjani is allowed to leave Portsmouth and join Premiership rivals Man City. Benjani eventually agreed a deal, but only after the transfer window was closed.
However, the 29-year-old striker only arrived at City's training ground at 11pm and club officials were unable to complete the formalities of his move in time for the midnight deadline.
"Due to the late arrival of the player in Manchester, we were unable to complete the transfer," spokesman Paul Tyrrell told the club's official website.
Pompey boss Harry Redknapp was confident the deal would go through and signed Tottenham Hotspur striker Jermain Defoe as a replacement.
But the deal could now be resurrected by the Premier League should they rule in City's favour.
